These Terms of Service (“Terms”) govern your access to and use of datacaiman (“we”, “us”, “our”) and the website datacaiman.com (the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Overview of the Service

datacaiman is an API platform that provides programmatic access to data from publicly available web sources, including search engines, social media platforms, real estate listings, and others.

The Service:

  • Provides REST API endpoints that retrieve publicly available data on your behalf
  • Uses a credit-based system where each API call consumes one or more credits
  • Requires authentication via API keys

Our APIs return data sourced from third-party websites. We do not guarantee the accuracy, completeness or timeliness of that data.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old (or the age of legal majority in your jurisdiction), and
  • Have the authority to enter into these Terms on your own behalf or on behalf of the organization you represent.

By using the Service, you represent that you meet these requirements.

3. Accounts and API keys

To use the Service, you must create an account and generate at least one API key.

You agree to:

  • Provide accurate and up-to-date information
  • Keep your login credentials and API keys confidential
  • Be responsible for all activity performed using your API keys
  • Revoke any API key you believe has been compromised

4. Credits, plans and billing

Access to the Service is governed by a credit-based system:

  • Each API call consumes one or more credits, depending on the endpoint. See the documentation for per-endpoint costs.
  • Credits are allocated based on your plan (Free, Pro, Business).
  • Free plan credits are a one-time allocation and do not renew.
  • Paid plan credits reset at the start of each billing period.

We may offer the following plans (current pricing is shown on the website):

  • Free – one-time credit allocation, no subscription required
  • Pro – recurring monthly or annual subscription with monthly credit renewal
  • Business – recurring monthly or annual subscription with higher monthly credit renewal

Paid subscriptions are billed in advance on a recurring basis via our payment provider (Polar or Stripe, depending on the checkout flow). All payment processing is subject to the payment provider’s own terms and policies.

We may suspend or terminate your access to the Service if we cannot process payment for a paid plan.

5. Cancellation

You can cancel your subscription at any time via the billing page in your dashboard or by contacting us.

When you cancel:

  • Your subscription remains active until the end of the current billing period.
  • Unused credits at the time of cancellation are not refunded, unless otherwise stated.
  • We may keep your account and data unless you ask us to delete them, subject to our Privacy Policy.

6. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Violate the terms of service of any third-party platform whose data is accessed via our APIs
  • Harass, threaten or harm others
  • Collect or store personal data about individuals without a lawful basis
  • Attempt to gain unauthorized access to accounts, systems or data
  • Reverse engineer, decompile or attempt to extract source code, except as permitted by law
  • Resell or redistribute access to the Service or data obtained through it without our prior written consent
  • Use the Service in a way that could interfere with or disrupt the Service or infrastructure
  • Circumvent rate limits, credit accounting, or other technical controls

You are responsible for ensuring that your use of data retrieved through the Service complies with all applicable laws and the terms of the underlying third-party platforms.

7. Data from third-party sources

Our APIs retrieve data from publicly available third-party websites and platforms. You understand and agree that:

  • We act as a technical intermediary and do not own or control third-party data.
  • We do not guarantee the accuracy, completeness, availability or legality of data retrieved.
  • Third-party platforms may change, restrict or block access at any time, which may affect the Service.
  • You are solely responsible for how you use the data retrieved through the Service.

8. Service availability and changes

The Service is provided on an “as is” and “as available” basis. We may modify, suspend or discontinue the Service (or any part of it) at any time, with or without notice.

Credits are refunded automatically if a request fails due to an error on our side (5xx response). Credits consumed for successful requests are not refunded.

9. Intellectual property

We (and our licensors) own all rights, title and interest in and to the Service, including software, design, user interface and content we provide.

Subject to these Terms and your payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes.

You may not:

  • Copy, modify or create derivative works of the Service
  • Resell, rent or lease access to the Service to third parties
  • Use the Service to build a competing product

10. Third-party services

The Service may integrate with or depend on third-party services, including payment providers, analytics tools and identity providers.

We are not responsible for the availability, performance, content or privacy practices of third-party services. Your use of third-party services is governed by their own terms and policies.

11. Limitation of liability

To the maximum extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from:

    • Your use of or inability to use the Service
    • Any conduct or content of any third party
    • Any data obtained through the Service
    • Unauthorized access, use or alteration of your account or API keys
  • Our total liability for any claims arising out of or related to the Service or these Terms will be limited to the amount you paid us in the 3 months preceding the event giving rise to the claim (or, if you use only the free plan, to EUR 0).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnity

You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights or terms of service
  • Data you collect, store or process using the Service

13. Changes to the Service and to these Terms

We may update the Service and these Terms from time to time. When we make material changes, we may notify you by email or within the Service. If you continue to use the Service after changes take effect, you agree to the updated Terms.

If you do not agree to the updated Terms, you should stop using the Service and cancel any paid subscription.

14. Governing law

Unless otherwise required by mandatory local law, these Terms are governed by and construed in accordance with the laws applicable where datacaiman is established, without regard to conflict of law principles.

You and datacaiman agree to submit to the non-exclusive jurisdiction of the competent courts in that jurisdiction.
